It’s a useful phrase and an unhelpful one, because no jurisdiction has a leave type called stress leave. What people are actually taking is sick leave, medical leave or disability leave. The condition is different; the machinery is the one that handles a broken ankle. ### When it becomes a protected absence Feeling under pressure at work isn’t, by itself, a legal status. What switches protection on is a clinically significant condition certified by a health practitioner — and at that point the ordinary sick leave and disability frameworks apply in full. Two principles travel across jurisdictions, both worth knowing before the first request lands. You can ask for certification, not a diagnosis. US guidance is explicit: a health care provider “may, but is not required to, provide a diagnosis.” The UK fit note (https://vacationtracker.io/glossary/fit-note/) works the same way — it needn’t name the condition. The employer is entitled to know a qualifying condition exists and roughly how long it will last, not what it is. Watch your absence metrics. Mental-health-related absence is often frequent and short rather than one long block — the pattern no-fault point systems and the Bradford Factor (https://vacationtracker.io/glossary/bradford-factor/) penalise hardest. Score it mechanically and you escalate against the people most likely to be legally protected. Three frameworks can apply. FMLA: Department of Labor guidance states plainly that “both physical and mental health conditions qualify for FMLA leave.” One qualifies as a serious health condition where it involves inpatient care, continuing treatment, or is chronic — periodic visits to a provider with recurring periods of incapacity. That last route is how intermittent leave for anxiety or a mood disorder is usually taken. The ADA may separately require reasonable accommodation, including leave, for a mental impairment that substantially limits a major life activity. Pay comes from state sick leave laws, state paid family and medical leave (https://vacationtracker.io/glossary/paid-family-leave-pfl/), or short-term disability (https://vacationtracker.io/glossary/short-term-disability/) — never from FMLA itself. ### Canada Federally regulated employees get up to 10 paid medical leave days a year after 30 days’ service, plus 27 weeks of unpaid, job-protected medical leave. A certificate can be required for absences of five days or more. Ontario has 3 unpaid sick days and, since 19 June 2025, a 27-week unpaid long-term illness leave for employees with 13 weeks’ service, on a practitioner’s certificate confirming a serious medical condition. Quebec provides 2 paid days within a wider pool of family and health absences, plus up to 26 weeks’ unpaid leave for illness. British Columbia gives 5 paid and 3 unpaid sick days after 90 days, plus up to 27 weeks of unpaid leave for the employee’s own illness. A note can be required only for absences over five consecutive days. Other provinces run the same shape with different numbers, and across all of them human rights law imposes a duty to accommodate mental disability to the point of undue hardship — usually a bigger factor than the statutory day counts. EI sickness benefits supply the pay: up to 26 weeks at 55% of earnings, capped at $729 a week (the cap changes - it’s indexed annually), on a medical certificate. ### Internationally The UK has no stress leave either. An employee self-certifies for seven calendar days, then needs a fit note. Statutory Sick Pay now starts on day one, following the April 2026 change, and where a condition is long-term, the Equality Act’s reasonable adjustments duty applies. Most of Europe runs sickness benefit through social insurance on a medical certificate, typically for longer paid durations than either North American system. ### Frequently asked questions Is stress leave a real legal entitlement? Not under that name anywhere. It’s sick or medical leave for a mental health condition, under the same rules as any other certified absence. How long can stress leave last? As long as the certification and the applicable entitlement support — a few days, or up to 26 or 27 weeks of job-protected leave in much of Canada. Can an employer ask what the condition is? Generally no. They can require certification that a qualifying condition exists and its likely duration, not the diagnosis. Is stress leave paid? It depends on what else applies: statutory paid sick days, a state or social insurance scheme, short-term disability, or employer policy. Sick leave, disability and accommodation obligations vary by country, US state and Canadian province.
