Employees become entitled to vacation privileges after 12 months at the same employer. After 6 continuous years in the same company, an employee is entitled to 1 month of paid vacation in the 7th and 8th years of service. This pattern is repeated every 6 years of employment with the same employer. Employees working part-time do not have regular vacation leave guaranteed by law. ### Carry Over Allowed, up to 6 months. An employee may carry over (https://vacationtracker.io/glossary/carryover/) unused vacation days to the following year. However, there is a limit: they must be taken within six months. ### PTO Payout at Termination An employer must reimburse an employee his or her regular wages when employment is terminated. ## Sick Leave in Indonesia Unlimited leave. Generally, there is no limit to days of sick leave an employee can take, and they are paid according to how many months it lasts. An employee must show or submit a medical certificate of an injury or illness from a doctor. In case of severe illness or injury, an employee may request to take long-term sick leave, which may last for more than 1 year, provided it is advised in writing by a doctor. A female employee who feels sick and unable to work while going through menstruation can take paid time off during the first 2 days of her period. Payout Sick pay depends on the duration of absence. - 100% of the regular salary: In the initial 4 months; - 75% of the regular salary: From 4th to 8th months; - 50% of the regular salary: From 8th to 12th months; - 25% of the regular salary: From one year to dismissal. ## Special Types of Leave in Indonesia 2 days An employee can take 2 days of paid time off their child’s: Baptism, Circumcision, Marriage, or Unfortunate event of the death. ## Maternity and Paternity Leave ### Maternity Leave in Indonesia 3 months An employee who becomes pregnant is entitled to regular 3 months of fully paid maternity leave. One and a half months is to be taken before childbirth and one and a half months afterward. The maternity leave can’t be extended at the will of an employee but can be extended if an obstetrician and a gynecologist officially request it in writing. An employee may receive up to an additional three months of leave in special conditions proven by a doctor, such as health problems, postpartum complications, miscarriage, or when the newborn experiences health issues. An employer is also required to provide specified facilities for a new mother in order to breastfeed their child during work. Payout Maternity leave is paid by the employer at 100% of the regular salary. In case that maternity leave is extended, payment is as follows: First 3 months: 100% of the regular salary; Fourth month: 100% of the regular salary; Fifth and sixth month: 75% of the regular salary. ### Miscarriage Leave An employee who goes through the unfortunate event of a miscarriage is still entitled to 1.5 months of maternity leave. ### Paternity Leave in Indonesia 2 days An employee is allowed to take 2 days of paid paternity leave when he becomes a father of a child. This leave also applies in the unfortunate event of a miscarriage. A company policies may offer more generous time off. Payout of paternity leave Paternity leave is paid by the employer at 100% of the regular salary. ## Civic Duty Leave in Indonesia Required by law, duration not specified. Employees are allowed to take paid time off to fulfill their civic obligations and duties to the state. ## Bereavement Leave in Indonesia 1 or 2 days Employees in Indonesia are entitled to up to: - 2 days of paid bereavement leave in case of the death of a parent or a parent-in-law; a spouse; child or child-in-law. - 1 day of paid bereavement leave in case of the death of a close member of the employee’s family. Additional days may be subject to employer policy. ### Jury Duty Leave in Indonesia Jury duty leave is not specified by Indonesian leave laws because legal system does not use juries. ### Military Leave in Indonesia If a male employee is drafted for military service, his employment ends on the start date of his conscription. Once his service is over, he can reapply for his job, but rehiring will depend on whether a suitable position is available. ### Voting Leave in Indonesia On election day, employers must give employees the time to vote. If employees are scheduled to work, the company must adjust shift schedules so everyone can still make it to the polls. ## Public Holidays in Indonesia The government of Indonesia makes decisions each year regarding whether a public holiday that occurs on a weekend will be transferred to a working day or not observed at all. Working days on public holidays are allowed if the job demands continuous, uninterrupted operations or if both parties (an employee and an employer) have agreed to it. In this case, the employer must pay overtime.
