What employers need to know

Paid holidays

Idaho law doesn't require employers to give vacation, holiday, severance or sick pay, or to give holidays off.

Working on a holiday

Idaho law doesn't require premium pay rates for work on weekends or holidays.

Holidays and overtime

Overtime in Idaho follows the federal Fair Labor Standards Act: hours over 40 in a workweek must be paid at no less than 1.5 times the regular rate. Each workweek stands alone; you can't average two or more weeks.

Holidays that fall on a weekend

Federal offices observe Saturday holidays on Friday and Sunday holidays on Monday.

Unused vacation when someone leaves

Idaho has no state statute on paying out accrued vacation at termination. The employer owes it only if its policy or employment contract stipulates it.

From our Idaho leave laws guide

Sick leave

No Idaho law requires private employers to provide sick leave, paid or unpaid. Federal FMLA allows eligible employees up to 12 weeks of unpaid leave.
