What employers need to know
Paid holidays
Federal law (the FLSA) doesn't require Wyoming employers to pay for holidays that aren't worked. Holiday pay is a matter of agreement between the employer and the employee.
Vacation payout at separation
In Wyoming, you have to pay out unused vacation when an employee leaves unless your written policy clearly says otherwise and the employee acknowledged it. Unused sick and personal leave doesn't have to be paid out.
Use-it-or-lose-it vacation
Wyoming employers can have unused vacation expire, but only if employees had a fair chance to use it. You can also make new hires wait until their first anniversary to start earning vacation.
Holidays that fall on a weekend
Federal offices observe Saturday holidays on Friday and Sunday holidays on Monday.
Sick leave
Wyoming has no sick leave law requiring employers to provide paid or unpaid sick leave, beyond the federal FMLA's 12 weeks of unpaid leave.
