What employers need to know

Paid holidays

Oregon law does not require private employers to give paid holidays. If you have a holiday pay policy or agreement, you must follow it.

Working on a holiday

Oregon doesn't require time and a half just because an employee works a legal holiday. Holiday pay follows the employer's policy.

Holidays and overtime

A holiday in the week doesn't change Oregon's overtime rule: time and a half is owed for hours over 40 in a workweek. Mills, factories and other manufacturing establishments must also pay time and a half for hours over 10 in a day (ORS 652.020).

Holidays that fall on a weekend

Federal offices observe Saturday holidays on Friday and Sunday holidays on Monday.

Unused vacation when someone leaves

Oregon law does not require payout of accrued, unused vacation at separation. It must be included in final wages only if the company policy or employment contract requires it or is silent on the matter.

From our Oregon leave laws guide

Sick leave

All Oregon employers must provide sick leave, 1 hour for every 30 hours worked, with a 40-hour annual accrual cap. Employers with 10 or more employees (6 or more in Portland) must make it paid leave.
