A leave year is the twelve-month period over which leave entitlement is granted, used and reset. It’s the clock everything else in a leave policy runs on: accrual rates, carryover deadlines, proration for joiners and leavers, front-loading dates, and the point at which liability is measured.

Four models cover almost all of it:

• Calendar year — 1 January to 31 December. Everyone aligned, easy to explain
• Fiscal year — matched to the financial year, so leave liability lands with budgeting
• Anniversary year — each employee’s own hire date and its anniversaries
• Rolling — a window measured backward from each request, with no fixed reset at all (see rolling calendar year)

What the choice actually decides

The entitlement is the same either way. What the leave year decides is when the pressure lands.

Under a common leave year, everyone’s deadline falls on the same date. December becomes a scramble of unused days, coverage is thinnest exactly when carryover expires, and January starts with everyone’s balance full. The upside is simplicity: one closing date, one liability snapshot, one carryover rule.

Under an anniversary year, that pressure is spread evenly across the calendar and nobody faces a collective deadline. The cost is administrative: twelve different reset dates, carryover calculations that never batch, and two people doing the same job seeing different balances in March for reasons neither finds intuitive.

Most organisations pick a common year for communication and reporting, and accept the December crunch as the price.

United States

There is no federal vacation year, so for PTO the leave year is purely a policy choice. For statutory leave, it is not.

The FMLA defines its own twelve months, and the employer must choose one of four permitted methods: the calendar year, any fixed year such as a fiscal year, a period measured forward from first use, or a rolling period measured backward. Two rules matter more than the list. An employer that fails to designate a method must apply whichever option is most favourable to the employee, request by request. And changing method requires 60 days’ notice to all employees.

State and city sick leave laws define their own year too, typically as a calendar year or a twelve-month period the employer designates, and those statutes govern their own entitlements regardless of what your handbook says about PTO.

The practical consequence is the multi-clock problem: a US employer can easily be running three different twelve-month periods at once — a calendar PTO year, a rolling-backward FMLA year, and a statutory sick leave year — none of which align. That’s manageable if it’s deliberate, and a compliance problem when someone assumes there’s only one clock.

Canada

Ontario makes the structure explicit, and it’s worth knowing because the terminology is statutory rather than conventional.

The default is the standard vacation entitlement year: a recurring twelve-month period beginning on the employee’s date of hire. An employer may instead adopt an alternative vacation entitlement year starting on a date of its choosing — 1 January, say — converting the whole workforce to a common year.

Doing so creates a stub period: the stretch between the hire date (or the end of the last standard year) and the start of the first alternative year. Vacation for a stub period is prorated.

Under either model, vacation earned in a completed entitlement year or stub period must be taken within ten months after that period ends — and the employer carries an obligation to ensure it is scheduled and taken, not merely to permit it.

Internationally

United Kingdom. Regulation 13(3) of the Working Time Regulations lets a “relevant agreement” — typically the contract — set the leave year. If nothing does, the statutory default applies: the leave year begins on the date employment started, and on each anniversary.

That default catches employers out. An organisation that never wrote a leave year into its contracts does not have a calendar leave year by implication. It has a different leave year for every employee, which is precisely the administrative outcome it assumed it was avoiding. Fixing it later means a transitional period and amended terms.

Australia. There is effectively no leave year for annual leave. Entitlement accrues progressively throughout employment and unused leave rolls over indefinitely, so there is no annual reset to manage — no carryover deadline, but also no natural moment at which balances get cleared down.

This entry is general information, not legal advice. Statutory leave-year definitions vary by country, US state and Canadian province.
