“Mandatory vacation” and “minimum vacation” describe three different things, and conflating them causes most of the confusion around the term:

• A statutory minimum — the floor of paid vacation an employer is legally required to provide
• A minimum vacation policy — an employer rule requiring employees to actually take a set number of days
• A mandatory absence requirement — a regulatory control requiring certain employees to be away from their duties for a continuous period

What links them is that someone other than the employee has decided leave must happen. The reasons differ completely: the first protects rest as an entitlement, the second protects it against under-use, and the third has nothing to do with rest at all.

United States

The US is the outlier among developed economies: there is no federal statutory minimum vacation entitlement, and no state provides one either. Paid vacation is a benefit, not a right.

So when a US employer says “mandatory vacation,” they almost always mean one of the other two senses.

Minimum vacation policies have grown alongside unlimited and flexible time off. Removing the balance removes the signal of what is acceptable, and uptake suffers. A stated floor — “everyone takes at least 15 days” — restores the permission the balance used to give. Treated as a target rather than a rule, it rarely works; treated as an expectation managers are accountable for, it does.

Mandatory absence in financial services is the sense most people don’t know about, and it’s a genuine regulatory expectation rather than a wellbeing measure.

Longstanding FDIC guidance recommends that active officers and employees be absent from their duties for not less than two consecutive weeks, uninterrupted. The reasoning is explicit: a substantial embezzlement “usually requires the constant presence of the embezzler to manipulate records,” handle inquiries and avoid detection. Force the absence and the irregularity surfaces.

Two conditions make or break it. Someone else must genuinely take over the duties — if the work simply waits, the control achieves nothing. And where an institution’s policy falls short of two weeks, the expectation is board-level review and strictly enforced compensating controls such as personnel rotation.

That makes mandatory absence a leave policy with an audit trail attached, and it’s why banks track consecutive-day absence rather than total days off.

Canada

Every jurisdiction sets a statutory floor, and it rises with service.

Federally regulated employers provide two weeks of vacation after one year of continuous employment, three weeks after five years and four weeks after ten — with vacation pay of 4%, 6% and 8% of gross earnings respectively.

Ontario requires two weeks after one year, rising to three weeks after five years of employment.

Quebec requires two consecutive weeks after one year, with the third week arriving earlier than elsewhere — at three years of uninterrupted service, with the indemnity rising from 4% to 6%.

In all cases these are minimums an employer must provide and cannot contract out of, not targets employees must hit.

Internationally

European Union. The Working Time Directive sets a floor of four weeks of paid annual leave, which member states implement and many exceed.

United Kingdom. 5.6 weeks — 28 days for a full-time, five-day worker. Unusually, that figure may include public holidays, so an employer offering “20 days plus bank holidays” is meeting the minimum rather than exceeding it.

Australia. Four weeks under the National Employment Standards, rising to five weeks for certain shift workers.
