What employers need to know
Who qualifies
To qualify for a paid public holiday, an employee must have been employed for at least 90 calendar days in the 12 months before the holiday. They must also have worked their regular scheduled day before and after it, unless they have a good reason, and must work the holiday if they agreed to. Employees who choose when they work, and some occupations (for example law, medicine, engineering, real estate and car sales), don't qualify.
Holiday pay
A qualifying employee who doesn't work the holiday gets a regular day's pay. If their wages vary from day to day, pay is an average day's pay based on all hours worked, excluding overtime, in the 30 days before the holiday. Instead of holiday pay, you can pay an extra 4% of all gross wages from the employee's first day of work.
Working on a holiday
A qualifying employee who works the holiday gets a regular day's pay plus 1.5 times their regular wage for each hour worked. Employees who don't qualify still get 1.5 times their regular wage for hours worked on the holiday. If you pay the 4% option, you must still pay 1.5 times the regular rate for hours worked on the holiday.
Holidays that fall on a weekend
If a holiday falls on a non-working day or during the employee's vacation, a qualifying employee gets another working day off with pay. If the employee agrees, you can pay a regular day's pay instead. You can also agree on a substitute day off, which must be taken by the employee's next vacation and recorded in payroll as the holiday.
