What employers need to know

Who qualifies

An employee doesn't get paid for a general holiday they don't work if they haven't worked for you for a total of 30 days in the past 12 months. They also lose holiday pay if they skip work on the holiday after being called in, or miss their last regular working day before or after the holiday without your consent. Employees on pregnancy or parental leave aren't paid for the holiday.

Holiday pay

Employees paid by time get at least what they would earn at their regular rate for their normal hours. Employees paid any other way get at least their average daily wages from the four weeks they worked right before the week of the holiday.

Working on a holiday

If you require an employee to work a general holiday, pay them their regular holiday pay plus at least 1.5 times their regular rate for the hours worked. Instead, you can give them another paid day off at a time that suits you both, no later than their next annual vacation or the end of their job, whichever comes first. If an employee has the holiday off, asking them to work another normally free day that week costs at least double their regular rate.

Holidays that fall on a weekend

If a general holiday falls on an employee's non-working day, you either pay them their normal holiday pay or give them a paid day off at a time that suits you both. That day off must be taken no later than their next annual vacation or the end of their job, whichever comes first.
