What employers need to know
Who qualifies
To get paid for a general holiday they don't work, an employee must have been employed for 30 calendar days before the holiday and must work their last scheduled shift before it and their first scheduled shift after it, unless the employer agreed to the absence or the Employment Standards Act allows it. They must also come in on the holiday if they were called in to work. An employee who was already on unpaid leave they asked for, for 14 days in a row right before the holiday, doesn't get holiday pay.
Holiday pay
Salaried staff get their normal weekly or monthly pay with no deduction for the holiday, and hourly or daily staff get at least what they would earn on a normal day. Employees who work less than standard hours (8 a day, 40 a week) or irregular hours get at least 10% of their wages for the hours worked in the two weeks before the week of the holiday. Commission-only staff get an average day's pay for the holiday week, not counting overtime or bonuses.
Working on a holiday
An employee who works a general holiday gets their regular holiday pay plus either the overtime rate for every hour worked that day, or their regular rate for those hours plus a paid day off. The day off can be added to their annual vacation or taken on a date you both agree on. In a week with a general holiday, overtime starts after 32 hours instead of 40.
Holidays that fall on a weekend
If a general holiday falls on a day the employee doesn't normally work, such as a Saturday or Sunday for a Monday to Friday worker, they get a paid holiday on their next working day after it. If you ask an employee who has the holiday off to work another normally free day in that same week, you must pay at least the overtime rate for that day.
