Statutory Holiday

A statutory holiday — shortened to “stat holiday” or just “a stat” — is a public holiday that employment law attaches a legal entitlement to. The term is Canadian, and the entitlement is what distinguishes it.

That matters more than it sounds, because the equivalent days in the US and UK carry no such thing.

It’s an entitlement, not a date

A US federal holiday or a UK bank holiday designates a day. Banks and government offices close; private employers do as they like, and whether staff get the day, get paid, or get anything for working it is contractual.

A statutory holiday creates three separate obligations:

• a day off on the holiday
• holiday pay for that day, calculated by a prescribed formula
• premium pay or a substitute day if the employee works it

An employer can’t satisfy the first and ignore the rest, and the second is where most mistakes happen.

Canada

Federally regulated employers — banks, airlines, telecoms, interprovincial transport — follow the Canada Labour Code, which sets 10 general holidays. Anyone required to work one must be paid at least 1.5 times their regular rate, plus the holiday pay. Managers and professionals instead get their regular rate and a substitute paid holiday.

Ontario has 9 public holidays under the Employment Standards Act, with premium pay at 1½ times for hours worked on one. A substitute day must be scheduled within three months — twelve if the employee agrees in writing — and written notice must identify it before the holiday.

Quebec has 8, including the National Holiday on 24 June, which reaches almost every worker there. One quirk: the spring holiday is Good Friday or Easter Monday, at the employer’s choice — not both.

Other provinces and territories range from around six to thirteen, each with its own list, several with holidays nobody else observes — Islander Day, Louis Riel Day, Nunavut Day. A national employer runs a dozen holiday calendars, not one.

How holiday pay is actually calculated

This is the part that trips employers up.

Holiday pay generally isn’t “a normal day’s pay.” Federally, in Ontario and in Quebec it’s one twentieth of the wages earned in the four weeks before the week of the holiday — a formula, not a shift.

The reasoning is sound: twenty working days in four weeks, so one twentieth is an average day. For a steady full-timer that lands close to a day’s pay. For part-time, variable-hours or seasonal staff it prorates automatically, which is the point. Pay everyone “a day’s pay” and you overpay some and underpay others — and the underpayments generate the complaints.

The inclusions differ: Ontario counts regular wages plus vacation pay payable in those four weeks, Quebec includes tips but excludes overtime.

Then there’s the qualifying rule, the most disputed piece. Ontario’s “last and first rule” says an employee loses public holiday pay if they fail, without reasonable cause, to work their last regularly scheduled day before the holiday or their first after it — and those needn’t be the days immediately either side. Quebec applies a comparable test.

Employees assume the pay is automatic. It generally is — just not if they no-show either side of it.

Outside Canada

In the US the term isn’t really used: federal holidays bind federal employees, and private employers owe nothing. In the UK and Ireland the equivalent days are bank or public holidays — Ireland attaches an entitlement, the UK doesn’t, and there they can be counted inside the 5.6 weeks of statutory annual leave.
