What employers need to know

Who qualifies

Manitoba has no minimum length of service: even an employee who started the day before the holiday gets general holiday pay. They lose it if they are absent without permission on a holiday they were scheduled to work, or on their last scheduled workday before or first scheduled workday after the holiday. Election officials and other temporary staff appointed under The Elections Act are not entitled.

Holiday pay

Employees who always work the same hours get one regular day's pay. Employees whose hours or wages vary get 5% of their gross wages, not counting overtime, from the 4 weeks just before the holiday. Construction employees get 4% of gross earnings instead, which is often paid on every cheque.

Working on a holiday

Most employers pay general holiday pay plus 1.5 times the regular wage for hours worked on the holiday. Some employers, such as gas stations, hospitals, hotels, restaurants and continuously operating businesses, can pay regular wages instead if they give another day off with holiday pay within 30 days. With agreement, that day off can be taken before the employee's next annual vacation.

Holidays that fall on a weekend

If a holiday falls on a Saturday or Sunday the employee doesn't normally work, they get the next regular workday off with general holiday pay. If it falls on a weekday they don't normally work, you must give them a normal workday off with holiday pay before their next vacation, or at another time they agree to. Under a union agreement or with the written agreement of most employees, you can move any holiday except Orange Shirt Day to another day within 12 months.
