What employers need to know
Who qualifies
Employees under the Labour Standards Act get paid public holidays, but there are two exceptions. An employee is not entitled to holiday pay if the holiday falls within their first 30 days of employment. They also lose it if they miss their regular work day just before or just after the holiday without just cause or the employer's consent.
Holiday pay
An employee who qualifies gets paid for the public holiday even though they do not work. Holiday pay is the employee's hourly rate multiplied by the average number of hours they worked per day in the 3 weeks before the holiday.
Working on a holiday
Employers cannot require employees to work on a public holiday unless the business is a public utility, an essential service, or one that normally runs without regard to Sundays or holidays. If the employee works the holiday, the employee chooses either twice their normal wages for the day or a paid day off within 30 days. When the employer and employee agree in advance that the holiday will be a working day, the employee can also choose to add one extra paid day to their annual vacation instead.
Holidays that fall on a weekend
If a public holiday falls on a day the employee is not normally required to work, the employee gets the next working day off instead, or another day the employer and employee agree on. That day is paid the same as the public holiday.
