What employers need to know

Who qualifies

When a paid holiday falls on an employee's work day, you must give them the day off with pay. An employee loses the paid holiday if they skip both their last scheduled work day before it and their first scheduled work day after it, without your permission or a reasonable cause. Employees who can choose whether or not to work when you ask them are also excluded.

Holiday pay

Holiday pay is 5% of the employee's wages earned in the 4 weeks before the holiday, not counting overtime. Pay for vacation taken and for any other paid holiday in those 4 weeks counts toward the total.

Working on a holiday

If an employee works a paid holiday, you have two options. Pay 1.5 times their regular wage rate for the hours worked plus their regular holiday pay. Or pay their regular rate for the hours worked and give them another paid day off, on a date you both agree, before their next annual vacation.

Holidays that fall on a weekend

If a paid holiday falls on a day the employee does not normally work, they still get a paid day off. It goes on their next work day after the holiday, their next work day after their annual vacation, or a day you both agree on before their next annual vacation. If the holiday falls during paid vacation, the vacation gets one extra work day.
