What employers need to know

Who qualifies

Full-time, part-time, permanent and term employees all qualify, no matter how recently they were hired. An employee loses the holiday entitlement only if, without reasonable cause, they miss all or part of their last scheduled day of work before the holiday or their first scheduled day after it. They also lose it if they skip a shift they agreed to work on the holiday, though most still get premium pay for any hours they do work.

Holiday pay

Add the employee's regular wages earned in the 4 work weeks before the week of the holiday to the vacation pay payable for that period, then divide by 20. Regular wages do not include overtime, vacation pay, public holiday pay or premium pay.

Working on a holiday

If an employee agrees in writing or electronically to work the holiday, they get regular wages for the hours worked plus a substitute day off with public holiday pay. If they also agree in writing, they can instead get public holiday pay plus premium pay (1.5 times their regular rate) for every hour worked, with no substitute day. The substitute day must fall within 3 months, or within 12 months if the employee agrees in writing, and the employer must give them a written statement of it before the holiday.

Holidays that fall on a weekend

If a public holiday falls on the employee's non-working day or during their vacation, they get a substitute day off with public holiday pay. If the employee agrees in writing or electronically, the employer can pay public holiday pay for the day instead, with no substitute day.
