What employers need to know
Who qualifies
In Quebec, full-time and part-time workers get paid statutory holidays, including temporary, casual and on-call workers, even if they were hired only a few days ago. A worker loses the paid holiday if they miss the work day before or after it without your permission or a valid reason beyond their control, like illness. Workers on extended sick leave, unpaid leave, parental or maternity leave, or layoff are not entitled. For the Quebec National Holiday (June 24), the worker only needs to be employed on that date.
Holiday pay
The holiday indemnity is 1/20 of the wages earned in the 4 complete pay weeks before the week of the holiday, not counting overtime. Reported or attributed tips are included. For workers paid by commission, it is 1/60 of the wages earned in the 12 complete pay weeks before the week of the holiday.
Working on a holiday
If a worker works a statutory holiday, you pay their wages for the day worked. You also choose one of two options: pay the holiday indemnity on top, or give them a paid day off worth the same amount. That day off must be taken within the 3 weeks before or after the holiday (different rules apply to June 24).
Holidays that fall on a weekend
If a holiday falls on a worker's normal day off or during their vacation, you either pay the holiday indemnity on top of that week's pay, or give a paid day off worth the same amount on a date you agree on. Canada Day moves to July 2 when July 1 falls on a Sunday. If June 24 falls on a Sunday, the day off moves to June 25, except for people who normally work Sundays.
